Arnie Rosner, I think you know that I do admire your unction for truth and sincerity. I respect you a lot. However, this does not mean that we cannot enlightened one another from our wisdom and past experiences. You know full-well my reputation in the judicial field having proceeded to the U.S. Supreme Court fifteen times over the last 25 or so years.

While your proposal is admirable, allow me to point out some shortcomings. Let's suppose we perfectly carry out this plan and all incumbent judges are voted out. We now need honest judges to replace these judicial vacancies. With our current system, here in California only qualified lawyers belonging to the California Bar Association may apply. According to the stated proposal, we need only to vote in honest lawyers belonging to the California Bar Association to judgeship. Perhaps I am missing something, but is this not somewhat like voting only honest thieves into office?

Further, there is another consideration to be made here. Let's suppose we do indeed vote in just the honest lawyers belonging to the California Bar Association, we must consider the admonition of Lord Acton, "Power tends to corrupt, and absolute power corrupts absolutely." All these honest lawyers belonging to the California Bar Association are going to be given the absolute power and protection of absolute judicial immunity. These "honest lawyers" shall be free to ignore their oaths of office and the Constitution they have sworn to uphold, and all the laws made in pursuance thereof, with impunity. They shall not be accountable for their actions, right or wrong. We are then at the mercy of these all powerful lawyers of the Bar Association to continue to be honest, in defiance of Lord Acton's principle, seeking to prove that indeed absolute power does not corrupt absolutely.

What is more, Arnie, these honest lawyers belonging to the California Bar Association, are compelled to look to the U.S. Supreme Court Justices that instruct them they are indeed covered by absolute judicial immunity should they chose to do evil and be dishonest. I have to admit that the faith that I would have to place in these honest lawyers of the Bar Association is beyond my ability. Can you help me on this point, Arnie?
