A few years ago I made an analogy of the future of America to a bath tub. Therein, I stated that a bath tub has two functionalitys; the faucet, and the drain. The faucet brings the water in, and the drain relieves the water that is brought in.
Every four years a presidential cycle takes place, and the question arises during these times, "Who do you thing is going to win?" Even now I am presented with this very question, "Who do I think is going to win?" To tell you the truth, I cannot answer the question as asked, but I can absolutely answer the inverse, who is going to loose. I have entitled this article, "He Who Controls The Drain Wins," so let us examine who controls the drain.
Among our Founding Fathers there arose a great contention over the issue of who controls the drain in government, and out of that arose the impeachment process for draining off those who violate the supreme law of the land. But not all were satisfied with the drain. For instance, Thomas Jefferson argued, “It has long been my opinion, and I have never shrunk from its expression... that the germ of dissolution of our federal government is in the constitution of the federal judiciary; an irresponsible body (for impeachment is scarcely a scarecrow) working like gravity by night and by day, gaining a little today and a little tomorrow, and advancing its noiseless step like a thief, over the field of jurisdiction, until all shall be usurped from the States, and the government of all be consolidated into one. To this I am opposed; because, when all government domestic and foreign, in little as in great things, shall be drawn to Washington as the center of all power, it will render powerless the checks provided of one government or another, and will become as venal and oppressive as the government from which we separated.”
Unfortunately, Thomas Jefferson's prediction that impeachment would only amount to a "scarecrow" has proven true, as only eight federal judges in America's history has been discharged by means of impeachment. This is hardly a decisive drain of wayward judges. The U.S. Constitution states judges "...shall hold their offices during good behavior..." Art. III, Sec. 1. The Constitution fails to define good or bad behavior, and it thus, has proven that all federal judges, once appointed and confirmed by the Senate, are in there for life, effectively providing no drain whatsoever for bad federal judges.
And when we look at the state judges, we see basically no difference. Whether a state judge is appointed or elected, no person can assume the bench who is not a member of the Bar Association. And even if one is a Bar member, he will not challenge a sitting judge for his seat on the bench, for it would be career suicide to challenge a sitting judge, and the end of his law practice if he is not successful. So, essentially, all state judges, as a matter of practicality, are in there for life, as there is no adequate drain system.
I am told that it is important that we get in a good president, as it is he who will appoint future judges and justices to the bench. But such view point is misguided, inasmuch as it is fatally distractive from the real issue, and places all emphasis only upon the faucet functionality of the tub. What about the drain? Drain? What drain? Yes, what drain? Not a one of the political parties is concerned about the drain.
Herein is the real problem. The proper way to function government is for the People to allow government to freely control the faucet, whether by appointment of judges, or by election, and the People must have control over the judicial drain, i.e., dismissing the judges who violate the Constitution, and the laws in pursuance thereof. There is absolutely no other way a Constitutional government can work or survive without this in place! It is too bad that our Founding Fathers did not have this idea in mind whenever they were debating how to hold the judges accountable without interfering with their independence.
This is why the premise of a People's Special Grand Jury, as established by JAIL4Judges, is absolutely necessary to a future other than that of a Third World Nation. There is no other way than People-Control of the judicial drain!
The yardstick of government in America is the Constitution. All public servants, whether Republican or Democrat, must swear by an Oath to uphold and defend that same Constitution. A yardstick has 36 inches, and it matters not whether such yardstick is red or blue. Likewise, all public servants must equally be bound to the very same standard, the U.S. Constitution, as the supreme law of the land.
Paragraph 2 of the J.A.I.L. Initiative states in part, "Notwithstanding common law or any other provision to the contrary, no immunities shielding a judge from frivolous and harassing actions shall be construed to extend to any deliberate violation of law, fraud or conspiracy, intentional violation of due process of law, deliberate disregard of material allegations, judicial acts without jurisdiction, blocking of a lawful conclusion of a case, or any deliberate violation of the Constitutions of this state, or the United States."
And since our theme is the "drain," Paragraph eighteen sets forth, "Removal. Whenever any judge has received three strikes, the judge shall be permanently removed from office, and thereafter shall not serve in any State judicial office." A strike is determined by this Special Grand Jury in finding a judge has willfully violated the Constitution or the laws of this country, and when such judge is found guilty by the jurors of criminal activity.
Now as to who is going to win this presidential election, I cannot tell. but I can tell you who is going to lose in this election, and that will be the People. The People have chosen by default to entirely overlook the most important issue in this election, controlling the drain. Therefore, I guarantee the People will lose this election.
