The impact JAIL4Judges has had upon this nation this past year is inestimable in that the establishment just cannot stop attacking J.A.I.L. (Judicial Accountability Initiative Law). Several State's Chief Justices this year have made J.A.I.L. the subject their State of the Judiciary messages. Some of the Chief Justices that have identified JAIL4Judges or referred to it are Hawaii, California, Missouri, Kansas, Pennsylvania and South Dakota.

 

The latest attack, which was published in yesterday's media, is by former U.S. Supreme Court Justice Sandra Day O'Connor at the recent four-day National Governors' Conference held at the Grand Traverse Resort and Golf Course in Traverse City, Michigan.

 

O'Connor is very concerned that J.A.I.L. will eventually bring all the judges of this nation under the rule of the law, which she consistently describes as "disrupting the independence of the judiciary." Evidently, she believes that the judges of this nation should be free to do as they will unrestrained by constitutional or legislative standards.

 

She also condemns the attempts by some congressional conservatives who have called for judicial impeachments of federal judges, and supports taking away the people's right to vote on judges in favor of judges being selected by politicians.

 

While she correctly acknowledges that our nation's judges are facing criticism like never before in her lifetime, she claims that America has the best judicial system in the world, and she wants to keep that status quo in that regard. 

 

J.A.I.L. has refuted her time and time again stating that justice will not come by political appointments to the bench, but rather by judicial accountability to the People. This is precisely what will be brought about by passage of J.A.I.L. in this country, which is what she fears. I have opposed her on CNN nationwide television.

O'Connor urges governors to improve civics education

TRAVERSE CITY — States must teach their students more about government or risk losing any future respect for laws and judicial rulings, former Supreme Court Justice Sandra Day O'Connor told a dwindling group of the nation's governors in Traverse City on Monday.

On the last day of the four-day National Governors Association conference at the Grand Traverse Resort, O'Connor said an uneducated public is responsible for recent harsh criticism of the judiciary.

She cited ballot initiatives in South Dakota and Colorado as examples.

In South Dakota, voters defeated a measure to strip governmental immunity from judges, opening them up to civil lawsuits from people who appeared in their courts. In Colorado, voters defeated a measure to put term limits on state Appeals and Supreme Court judges.

She also mentioned efforts to impeach federal judges. As recently as 2005, some conservatives were calling for the impeachment of Supreme Court Justice Anthony Kennedy for decisions he's made on a variety of issues, from the death penalty to citing international precedent in some of his opinions.

"Our judicial system has proven superior to any other form. It would be folly to squander this precious constitutional gift," O'Connor said. "And the key to maintaining the system lies in education of citizens and that's where you come in."

She told the governors that civics education should become mandatory for students and that the education should be interactive.

"We need debates, mock trials and personal engagement. We also need to capitalize on students' computer skills," she added. "And we need to offer opportunities that will engage the students more than reading some dull textbook."

Former Texas Supreme Court Chief Judge Tom Phillips told governors that the way states select judges is key to maintaining an independent judiciary.

"Judges are now making more controversial decisions than ever before, so political parties and interest groups are more interested than ever on who is serving," he said. "Money is flowing into campaigns in unprecedented amounts and very little of it is from widows and orphans."

He touted the states that had merit-based appointments to the judiciary, rather than partisan elections. In Michigan, state appellate and Supreme Court judges are nominated by political parties, but run as non-partisan candidates.
